How long they are issued for and what it depends on
The regulation states: the period authorised for a temporary resident’s stay is six months or any other period set by an officer based on three factors — the temporary resident’s means of support in Canada, the period for which they are requesting authorisation, and the expiry date of their passport or other travel document.
Six months is a starting point, not a guarantee. All three factors can reduce it: weak proof of funds, a short requested stay, or a passport close to expiry will each bring the figure down.
The count starts on the day the person first enters Canada after receiving authorisation to stay temporarily, and in all other cases from the date of entry.
The permitted period ends at whichever of the following occurs first: the day the person leaves Canada without prior authorisation to return; the day their work or study permit expires; if both permits exist, the day the second of them expires; and on certain other grounds.
- Six months is a general rule, not a minimum or a maximum
- The officer considers available funds, the requested duration, and passport validity
- The count starts from the first entry under this permit
- The period ends upon whichever event occurs first
Requirements that apply to everyone
The regulation imposes a set of conditions on all temporary residents, and it is worth knowing them to the letter, because breaching any one of them blocks the path to renewal.
Leave Canada by the end of the authorised stay period. Do not work unless permitted by the applicable sections of the regulations. Do not study unless permitted by law or regulation. Comply with all requirements imposed by orders under emergency and quarantine legislation.
For those permitted to work, there are additional restrictions on the choice of employer, listed separately.
The connection to renewal is direct: an application to extend status can only be filed if the person has complied with all conditions imposed on entry into Canada. In other words, breaching a condition is not a separate inconvenience — it is a barrier to renewal.
- Depart before the deadline
- Don’t work without a permit
- Don’t study without a permit
- Comply with requirements under emergency and quarantine legislation
How an extension is submitted
The rule is short and contains two conditions. A foreign national may apply to extend their stay in Canada as a temporary resident provided the application is submitted before the authorised period of stay expires and the applicant has complied with all conditions imposed at entry.
And then a formulation worth noting: the officer extends the permit if, upon review, it is established that the foreign national continues to meet the requirements of the relevant article of the regulations. The word used is ’shall extend’ — an obligation, not a discretion. Extension is not left to judgment: it follows automatically from meeting the requirements.
This leads to a practical conclusion: the real work is not in correspondence with the authority, but in preparing evidence that you still meet the requirements.
Supported status: how it works
This is the most valuable provision in the entire section. If a temporary resident has applied to extend their stay and no decision has been reached by the end of the permitted period, that period is extended: until the day the decision is made — if the application is refused; or until the end of the new permitted period — if the application is approved.
As a separate point: if the period is extended in this way, the temporary resident retains their status — subject to any other conditions imposed — for the duration of the extended period.
Let us look at what this means. A person applied for renewal a month before their permit expired. The permit expired; no decision has been issued. They do not become undocumented: their status is preserved automatically, under the regulation, until a decision is made. If rejected — the status holds until the day of the refusal. If renewed — until the end of the new term.
All of this works on one condition stated in the rule itself: the application must be submitted before the permitted period expires. Anyone who applies even one day late is entirely outside this protection — and that is precisely the line between ’waiting for a decision’ and ’being in the country without status’.
There is also an exception clause: the rule does not apply to a foreign national in respect of whom a declaration has been made under a special provision of the law.
| Situation | What happens to the status |
|---|---|
| Application submitted before expiry, decision pending | validity is extended, status is retained |
| Application approved | validity until the end of the new permitted period |
| Application denied | the validity runs until the day the decision is made |
| Application submitted after expiry | the protection does not apply |

Frequently asked questions
How long is a temporary resident admitted to Canada for?
As a general rule, six months. An officer may set a different period based on your means of support, the period you requested, and your passport expiry date.
When should you apply for renewal?
Until the end of the authorised period of stay. The second condition is that you have complied with all conditions imposed at entry.
What happens if the deadline passes and there is still no decision?
If the application was submitted on time, the period is extended automatically: until the day of the decision in the event of a refusal, or until the end of the new period if approved. Status is maintained throughout the entire extended period.
What if you submit one day late?
Protection does not activate. The status-preservation mechanism only works if you apply before the end of the permitted period, so a late application turns the waiting time into a period without status.
Can an officer refuse a renewal at their own discretion?
The rule is framed as an obligation: the officer extends the permit if, upon review, it is established that you continue to meet the regulatory requirements. Your job is to prepare evidence of compliance.
