How the procedure works
What a modification is
Modification is the process of switching from one type of permit to another without leaving Spain and without applying for a new visa — for example, from a student residence to a work residence, from a residence without the right to work to one with work rights, or from employed status to self-employment. Legally, this is a separate procedure with its own set of requirements, not an extension of what you already hold.
What the new regulations changed
The Foreigners Act regulations, approved by Royal Decree 1155/2024 and in force since May 2025, considerably simplified the transition from study residence to a work permit: the requirement for completed years of study and the national labour market situation test were removed — it is sufficient to have completed the programme or be in the final year. The application may now be filed by the foreign national themselves, not only by the employer. Royal Decree 316/2026, in force from 16 April 2026, further amended Article 190 — to prevent a gap between the expiry of the previous permit and the acceptance of a modification application — and extended access to modification for holders of residence permits on humanitarian grounds.
Timelines and the condition for entry into force
When switching from a permit without the right to work to one that includes it, the new permit is issued for one year and takes effect only upon the employee’s registration in the social insurance system — which must be done within one month of the date of notification of the positive decision. If, at the time of application, you have already lived for one year as a resident under a permit that allowed you to work, the next permit may be issued for four years.
What we need from you
- A valid permit or resident card and a valid passport
- Document supporting the new basis: employment contract, diploma or confirmation of final year of study, self-employment documents
- Proof of means or income as required by the new basis
- Completed EX forms and paid fees
- Willingness to register with social insurance within one month of the decision
What is holding the case up
- Application submitted too late — the previous permit had already expired
- Studies are not yet complete and the final year is still far off
- Social insurance registration not completed within the allotted month — the permit never comes into force
- The selected permit type is simply not eligible for modification under the regulations — there are several such categories
- A request for additional documents from the immigration office, with a limited time to respond
- The employer is not ready to sign a contract before a decision is issued, and the decision depends on the contract
