Turkish citizenship through marriage

Marriage to a Turkish citizen and citizenship: three years under Article 16 of Law 5901, the family unity requirement, how the marriage route differs from naturalisation, how the family is verified, and what happens upon divorce or the spouse’s death.

Marriage to a Turkish citizen does not grant citizenship — not on the wedding day, not automatically thereafter. It gives the right to apply, and only after three years of marriage that is still ongoing at the time of application. In return, the marriage route removes the hardest hurdles of the standard procedure: the five-year residency requirement, the language exam, and proof of income. In both cases the decision rests with the ministry and is not an obligation of the state.

What marriage gives you — and what it does not

Marrying a Turkish citizen does not in itself change the foreign spouse’s citizenship. Under Article 16 of Law 5901, an application may be submitted if the marriage has lasted at least three years and is ongoing at the date of application. The three years are counted from the date of marriage registration — not from the start of the relationship and not from the date of moving to Turkey.

Separate from citizenship is the family ikamet: the spouse of a Turkish citizen receives a residence permit on family grounds — a distinct procedure with its own timeline. The family ikamet is issued immediately after marriage and allows the holder to live in the country throughout those three years.

  • Marriage gives the right to apply, not the right to be granted
  • The three years are counted from the date of marriage registration
  • The marriage must still be ongoing on the date of application
  • A family ikamet helps you stay in the country throughout that period — it is a separate procedure

The four conditions of Article 16

The conditions are set out in law and assessed together, not selectively. Three years of marriage is only the first of them.

  • Marriage to a Turkish citizen has lasted at least three years and is ongoing
  • Spouses live in family unity (aile birliği)
  • No conduct incompatible with the marital union
  • No circumstances that would bar on grounds of national security or public order
A sham marriage is not a loophole — it’s a criminal offenceFamily unity is assessed not by a stamp but by facts: cohabitation, a shared address, an interview. The market offers ’marriages for citizenship’ — this is precisely the case where a refusal is not the end of it, and any citizenship obtained this way may be revoked.

Marriage or naturalisation: how the two paths differ

The standard naturalisation procedure under Article 11 of the same law requires a different set of documents. The comparison is useful even for married applicants: sometimes fewer than five years of residence remain before the three-year marriage mark is reached, and vice versa.

None of these pathways is an obligation on the part of the state.Meeting all the conditions gives you the right to have your application considered, not the right to a positive outcome. This is not specific to Turkey: naturalisation works this way almost everywhere, and a promise of a guaranteed result is the first sign that what you are being sold is not a service.

How family unity is verified

The application is reviewed by a provincial commission, while the factual aspects — whether the couple lives together and shares a household — are verified by the internal affairs authorities. The verification may include a visit to the address and separate interviews with each spouse. This is a routine part of the process, not a sign of suspicion directed at you specifically.

In practice, difficulties arise not for those who live together, but for those whose documents do not match: registered addresses in different cities, a lease in one person’s name, utility bills in another’s. It is worth getting your address details in order in advance.

What happens if the marriage ends

The law draws a distinction between two moments — before and after the decision. If the Turkish citizen dies after the application has already been submitted, the requirement to live in family unity no longer applies to the applicant. If the marriage is declared invalid, the spouse who entered into it in good faith retains the citizenship acquired.

Divorce before filing closes this route: the requirement of an ongoing marriage is checked as of the date of application. What remains is the standard naturalisation process, with its own residence requirement, language test, and income threshold.

Divorce while the application is pending — a separate conversationThe situation between filing and a decision is not as straightforward as the death of a spouse — it depends on the circumstances of the case. If this applies to you, it needs to be examined document by document, not through general articles online.

Frequently asked questions

How long after the wedding can you apply for Turkish citizenship?

After three years from the date of marriage registration, provided the marriage is still valid at the time of application. Applications submitted earlier will simply not be accepted on this ground.

Is it necessary to live in Turkey throughout?

There is no statutory residency requirement for the spousal route — unlike the general naturalisation procedure, which requires five years of continuous residence. However, family unity is verified, and it is difficult to demonstrate if the spouses are effectively living in different countries.

Is a Turkish language exam required?

The law does not require language proficiency for the marriage route. That requirement belongs to the general naturalisation procedure under Article 11, which calls for a level of Turkish sufficient for social integration.

Does marriage give the right to work in Turkey?

A spouse’s citizenship does not in itself confer the right to work, but it significantly simplifies the work permit: spouses of Turkish citizens in marriages of three or more years are exempt from the quota criteria, employer capital requirements, and minimum salary threshold.

What happens to citizenship in the event of divorce after it has been granted?

Citizenship acquired through marriage is not revoked upon divorce. The law also separately protects a good-faith spouse when a marriage is declared void: their citizenship is retained. Cancellation is possible where fraud is proven — that is, in cases of a sham marriage.

In briefMarriage to a Turkish citizen does not grant citizenship; it gives the right to apply after three years — and removes the residency requirement, language exam, and income proof that the standard procedure demands. In their place comes a condition absent from the standard route: family unity, verified on the basis of facts rather than a stamp. Keep track of both dates — the third anniversary of the marriage and the fifth anniversary of residence: the one that comes first is not always the one you expect.
